These Terms of Service (“Terms”) establish the contractual relationship between Jagya Construction Private Limited (“Company”, “we”, “us”) and prospective or contracted property owners (“Client”, “you”). By utilizing our website, booking engineering consultations, or executing a turnkey civil construction agreement, you acknowledge and accept these binding terms.
01.Scope of Architectural & Civil Services
Jagya Construction provides end-to-end turnkey residential, commercial, and interior design construction solutions. The comprehensive scope includes architectural CAD drafting, 3D elevation modeling, structural engineering analysis, soil test investigations, municipal map sanction assistance, procurement of certified primary materials, on-site supervision, and milestone-linked execution.
02.Zone-V Seismic Engineering Standards
Because Assam and Northeast India are classified under Seismic Zone V (the highest earthquake hazard category in India), all Jagya Construction structural designs strictly adhere to governing Bureau of Indian Standards (BIS) codes:
- ✦IS 1893 (Part 1): 2016 — Criteria for Earthquake Resistant Design of Structures.
- ✦IS 13920: 2016 — Ductile Design and Detailing of Reinforced Concrete Structures subjected to Seismic Forces.
- ✦Primary TMT Steel Only: All RCC columns, beams, and foundations exclusively utilize certified primary steel brands (Tata Tiscon / SAIL Fe 550D). No secondary re-rolled steel is permitted on site.
03.Itemized BOQ & Contractual Price Lock
Prior to the commencement of physical construction, each Client receives an itemized 180+ line-item Bill of Quantities (BOQ) detailing exact material grades, brands, tile specifications, electrical fixtures, and plumbing fittings.
Once the construction agreement is legally signed, the agreed project cost is locked. Jagya Construction absorbs any midway market price spikes in raw cement or TMT steel. No arbitrary contractor markups or surprise variation bills will ever be issued unless the Client explicitly requests structural expansions or finish upgrades in writing.
04.Milestone-Linked Payment Protocol
Payments are structured across verifiable construction phases, safeguarding client capital:
- ✦Milestone 1 (Mobilization & Foundation): Advance mobilization, soil excavation, footing reinforcement, and plinth beam casting.
- ✦Milestone 2 (Superstructure RCC): Ground and upper floor column casting, lintels, and roof slab shuttering/concreting.
- ✦Milestone 3 (Masonry & MEP Conduits): First-class red brickwork or AAC blocks, concealed electrical wiring, and CPVC plumbing lines.
- ✦Milestone 4 (Plastering & Waterproofing): Internal/external cement plastering, multi-coat crystalline waterproofing in bathrooms and roof terraces.
- ✦Milestone 5 (Finishing & Handover): Flooring tiles/granite installation, premium Asian Paints painting, sanitary fittings, electrical switchboards, final cleaning, and key handover.
05.Milestone Timelines & Handover Guidelines
Every executed agreement includes an estimated project delivery Gantt timeline structured around clear stage-gate milestones. Project execution is actively monitored to align handover with agreed schedules:
Project schedules are coordinated with active milestone tracking. Delivery timelines are subject to standard civil engineering provisions including timely milestone stage disbursements, site access readiness, client material selections, and standard force majeure conditions (such as severe monsoon flooding, statutory approval delays, or unforeseen regional disruptions) as defined in the individual signed construction contract.
06.10-Year Structural Integrity Warranty
Upon final project completion and full milestone clearance, Jagya Construction delivers an official, stamped 10-Year Structural Warranty Certificate covering:
- ✦Integrity and load-bearing capacity of RCC foundation columns, plinth beams, and structural floor slabs.
- ✦Prevention of structural differential soil settlement when footings are built as per our engineered soil test reports.
- ✦1-Year complimentary post-possession maintenance visits for surface sealants, plumbing joints, and electrical touch-ups.
07.Client Responsibilities
To enable smooth construction execution, the Client agrees to:
- ✦Provide clear, unencumbered land ownership title documents and demarcated plot boundaries.
- ✦Ensure temporary single-phase/three-phase electrical connection and clean water supply at the project plot for construction curing.
- ✦Process stage payment disbursements within 7 working days of milestone inspection and photo verification.
08.Intellectual Property & Blueprints
All architectural concepts, CAD floorplans, 3D facade renderings, and structural design calculations generated by Jagya Construction remain our intellectual property until the complete contract sum is cleared, at which point full physical and digital ownership rights for the specific property transfer to the Client.
09.Force Majeure
Neither party shall be liable for timeline adjustments arising from events beyond reasonable engineering control, including unprecedented severe Brahmaputra river flash floods, regional statutory bandhs/curfews, pandemics, or government-mandated quarry closures. In such events, project delivery schedules are automatically extended by the duration of the disruption.
10.Governing Law & Jurisdiction
These Terms and any project agreement executed hereunder shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or arbitration arising from construction operations shall fall under the exclusive jurisdiction of the competent courts of Guwahati, Kamrup Metropolitan, Assam.
